Retail Fireworks Checklist Item Information
 
 
Permitted Sale Dates.
Sale of fireworks not permitted before June 27 and not after July 5th
 
Discharge/100 feet from any place of Institution
fireworks not oermitted to be discharges within 100 feet from any place of institution.
 
Discharge from/under vechicles.
Fireworks not permitted to be discharge from, into, under, or on any vehicle whether it is moving or standing.
 
Discharge/Roadway.
Fireworks are not permitted to be discharge on a public roadway or the right-of-way adjoining a public roadway.
 
Discharge/100 feet from stand and storage area.
fireworks are not permitted to be discharge within 100 feet of ant retail stand or facility where fireworks are stored.
 
Records.
Each operator of a temorarily retail stand shall maintain a list of what consumer firworks items are on the premises, indicating the kansas licensed distributor from whom those items
were purchased.
 
Permitted by Law.
Bottle Rockets and Skyrockets are not permitted.
 
Fire Extinguishers.
Two portable fire extinguishers with a minimun rating of 2A. one must be perssurized water type. or Fireworks stands less than 200 square feet are only required to have one portable fire extinguisher.
 
Attenant on Duty.
Fireworks shall be under supervision of the store employee while open to the public.
 
No Smoking Sign.
Posted sign reads ''FIREWORKS -NO SMOKING''sign shall be 2in high on a contrasting background posted at each entrance or within 10 feet of every aisle.
 
Storage/Gasoline/Liquids.
Must be at least 50 feet from moter vehicle fuel-dispensing station

Minnesota
 
Sf3049 was introduced in to the Senate to Legalize all consumer fireworks year round.
Proponents cite advantages of a 4% user feen state sales tax staying in-state and other revenue issues. they have begun a grass roots effort to influence ploiticians.
 
 
Michigan
The travesty contines for four university students and the prank gone ballistic as was reported in November. The students were accused if throwing a bomb-like device onto a lawn (described by police as a pear-shaped) from a moving vehicle. they were arrested on a variety of felony charges, each facing 20 years total. Now the two young women have been sentenced to 18 months probation, 40 hours community service, and fined $613.00 each. another student pleaded guility to amisdemeanor and is yet to be sentenced, and the fourth student still facing felony charges, has asked for a trail.
 
All this in a coolege towm! Whatever happened to college high jinks and pranks? Whatever happened to kids will be kids? eighteen months probation for lighting off a Festival ball on someboby's private lawn seems like criminal justice system gone postal.

In colorado around the same time a high school staffer reported hearing gunshots, with at least one audible ricochet. police locked down the school only to discover four students acroos the street setting off fireworls anyboby ever hear ricocheting fireworks?
 
we promised not to editorialize but we can't help to wondering if the news media has the citizens in this county so worried that at the slightest sound above normal someboby is disaling 911 to report gunshots. perhaps Gunny Highway had it right when he said "Hell is a cluster F*( Or Govermment exists to protect us from each other where govermment has has gone beyond its limits is in deciding to protect us from ourselves)

DOT is cracking down on distracted drivers and Agency head Ray Lahood recently announced new measures, including one that bands texting by commercial drivers.
Violators beware; fines for commercial driver texting are up to $2,700.00

Status of Fireworks in Kansas

As we approach the 2010 fireworks season there have been some updates for new opportunities for selling fireworks in our state. Some cities and counties have opened their markets for us to utilize in the upcoming season. Here is a list of a few that I know of:
 
Russell
Larned
Seneca
Hays
Abilene
The county of Saline
 
These locations are great new opportunities for us to reach out and expand our retail fireworks operations. Please make sure to check with all local authorities on permits and requirements before planning your stand.
 

Dirty Jobs

By the time you read this it will have been accomplished: the immensely popular TV show
( Dirty Jobs) will air a segment on Tuesday, Dec. 15 at 9 p.m. on the Discovery Channel that shows their visit to Littlr Big Shots in Addison, Pennsylvania. Little Big Shots' owner
Al knoblach said that he contacted the show two years ago about the possibility of featuring his organization and that the actual filming was done last March.
 
The show's star Mike Rowe was unable to wear a respirator mask during the filming because he had to talk. Al said he expects to hear from other fireworks companies about the company's "inproper use of safety equipment". The production crew began on Monday, with the camera crew begining on Wednesday. Then on Thursady the star arrived and worked from 10 a.m. untill midnight to get the filming done.

Sedgwick county

County commissioners are in a debate over opening the" sale and the use of fireworks" in the county. After being overwhelmed with E-mails and phone calls and beat up at a public comment session. It's begining to dawn on them that they should go with the state standard.
 
Stay tune in for more as the commissioners will meet again after the new year.

CPSC Public hearing

The CPSC held a public hearing on November 10 on the implementation of it's consumer product safety incident database which would allow the public to report injuries or incidents

Transport of Consumer Fireworks

The U.S. Department of Transportation has alerted the industry of concerns regarding the transportation of consumer fireworks by both nonprofit and for-profit groups selling fireworks.
 
The Highway patrol has reviewed shipping documents of numerous transactions involving
transportation of consumer fireworks, by nonprofit/profit groups, that the agencies believe
were not in compliance with approprate DOT hazardous materials transportation rules.
 
If your groups sells fireworks for a fundraising or for profit activities, the transportation of  the consumer fireworks is considered " in commerce" and are under the jurisdiction of the DOT and must comply with the hazmat rules.
 
If a shipment of 1.4G fireworks exceeds 1,000 lbs gross weight, the transportation of the shipment must.
 
1. be in proper commercial vehicle,
2. be operated by a CDL hazmat driver,
3. be properly placarded,
4. have proper shipping documents,
5. be properly loaded, including blocking and bracing
 
Please familiarize yourself with the DOT hazmat rules.
